Eric Menendez And Lyle Menendez failed to appear in court when a judge pushed back the date of a resentencing hearing in their murder case.

Erik, 53, and Lyle, 56, were scheduled to appear remotely at a court hearing in Los Angeles on Monday, November 25. Judge Michael Jesic said he needed more time to get up to speed on the case and would not be ready until Dec. 11, the original date of the formal hearing. He postponed the re-sentencing hearing to January 30 and 31.

Us every week confirmed that Erik and Lyle could “hear everything” but never appeared in court due to technical problems with the prison power supply.

Erik and Lyle were arrested in 1990 on two counts of first-degree murder after their parents, Kitty and José Menéndez, were found shot to death in their home. The siblings later admitted to killing their parents after years of alleged physical, emotional and sexual abuse. They were ultimately convicted and sentenced to life without parole in 1996. after two high-profile trials.

Although their previous attempts to appeal the decision were rejected, recent high-profile television projects such as Monsters, The Menéndez Brothers and others apparently offered Erik and Lyle a chance at freedom. In October, the Los Angeles District Attorney George Gascon recommended that a judge sentence Erik and Lyle to 50 years in prison, which could make them eligible for parole and release to prison.

“I won’t say if (Erik and Lyle) have a plan (after their possible release from prison). I just think that to get through each day, you just have to ground yourself,” their lawyer Marc Geragos told exclusively We at the time. “It’s a long road from living without (parole) for almost 17 years to having hope.”

The request has become more complicated since Gascón lost his re-election bid earlier this month. Elected District Attorney Nathan Hochmantakes office on December 2. After Erik and Lyle also requested clemency, Gov. Gavin Newsom he said will postpone the decision to authorize Hochman to examine the file upon taking office.

Monday’s hearing considered two new pieces of evidence — which were not presented during Erik and Lyle’s initial trials — that support their allegations of sexual abuse by their father. The petition cited the singer Roy RosselloJosé’s allegations against José and a recently discovered letter from Erik wrote to his cousin Andy Cano describing her father’s alleged sexual abuse months before the murders.
