A federal judge of Maryland blocked a decree of President Donald Trump who sought to end the citizenship of the birth law for children born to those who have entered illegally in the United States.

The American district judge Deborah L. Boardman, appointed by Biden, published a national injunction on the decree on Wednesday, increasing a previous temporary injunction issued by a different court last month.

“The executive decree is conflict with the clear language of the 14th amendment, contradicts the 125 -year -old Supreme Supreme Court and goes against the history of citizenship of our country of 250 years of birth,” wrote Boardman .

“The United States Supreme Court resolutely rejected the interpretation of the president of the citizenship clause in the 14th amendment. In fact, no court in the country has never approved the president’s interpretation. This court does not will not be the first. “

Shortly after being sworn as president in January, Trump published an executive decree which sought to withdraw automatic citizenship from children born of undocumented immigrants in the United States, the order being planned to take effect 30 days After his signature.

Trump executive decree said that if the 14th amendment says: “All people born or naturalized in the United States and submitted to their jurisdiction are citizens of the United States and the State where they reside”, it has never been meant ” extend citizenship universally universally to all those born in the United States. “”

“The fourteenth amendment has always excluded people from citizenship of the unique birth law in the United States but not” subject to its jurisdiction “, reasoned.

The ordinance forbidden the government to issue “documents recognizing citizenship of the United States” for newborns whose “mother was illegally present in the United States and the father of the person was not an American citizen or a legal permanent resident at the time of the birth of the said person, or ((or (2) when the presence of this person’s mother in the United States was legal but temporary, and that the father of the person was Not an American citizen or a legal permanent resident at the time of the birth of said person.

Trump’s ordinance was quickly faced with several proceedings, including one filed by the American Civil Liberties Union and other organizations for the defense of progressive defenders.

American district judge John C. Coughhenour, a named Reagan based in Seattle, judged last month that the order was “manifestly unconstitutional” during a hearing on a trial brought by four states – Washington, Arizona, Illinois and Oregon.

“This unconstitutional and non-American executive decree will never take hope, thanks to the actions that the United States will undertake on behalf of its residents,” said Washington State General Nick Brown, who started The trial, in a statement.

“Citizenship of the right of birth clearly indicates that citizenship cannot be conditioned on its race, at the origin of ethnic or at the origin of their parents. It is the law of our nation, recognized by generations of lawyers, legislators and presidents, until the illegal action of President Trump.

In 1898, the United States Supreme Court ruled 6-2 in the case United States c. Wong Kim Ark that an individual born in California was indeed a citizen of the United States, even if his parents were Chinese nationals.
