ADJUSTMENT OF FORECASTS FOR FY 2024

“As announced in the ad hoc press release of July 21, 2024, the Company must adjust its forecasts for the 2024 financial year, published on April 30, 2024, and updated in the S1 report, because the provisions due to a lawsuit brought by a US competitor needs provisions to cover all legal expenses for the entire process, which will last between two and three years.

The competitor filed two different proceedings, one for two patent infringements in the district court, and the other before the ITC (International Trade Commission), aimed at prohibiting the importation into the United States of the Biofrontera lamp XL (see ad hoc press release of July 21, 2024 for more information)

The forecast remains unchanged regarding revenues (20 to 23 million euros) and regarding the cash position at the end of the year (1 to 3 million euros). However, the forecast EBITDA is now adjusted between -2 and 0 EUR and between -4.5 and -2.5 EUR. Additionally, the guidance is changed regarding the original EBIT between -3 million euros to -1 to -5.5 to -3.5 million euros. “
